RN Market has been making big changes recently. In 2010, we introduced our new finance program! This system has improved RN Market's ability to become one of the most affordable ways to become an Advanced Legal Nurse Consultant (ALNC), as well as upgrade to the Elite and/or Expert Curriculum.

Over the past several months, we have noticed that our nurses are busier than ever. This has lead to a high amount of re-certifications and association renewals to be put on the back burner. We have improved our ALNC & IAALNI notifications by providing 90/60/30 day courtesy expiration emails. We will also give a call on or before your expiration date to make sure you have received your renewal options. This is why it is important to notify us if your email or phone number or address changes.

Starting on May 20, 2011, our new policy for ALNC expirations are as follows: we are offering a 90-day grace period to bring your certification current, with a $250 charge. After 90-days, you will receive a letter if you have not renewed. This letter states you MUST remove your ALNC credentials in the use of privileges, rights and entitlements once issued by the LNI Institute for your Certification. If renewals are not obtained within the 90-day grace period, you must contact RN Market for further instructions.

Our IAALNI Association is a great way to network. We do suggest that all members fill in ALL profile information as soon as purchased. When we have cases and need specific nurses and/or experts, we will search the Association website first before sending out a mass email. LEGAL NURSE NEWS: FORENSICS- The Present, Past, and Future

FORENSICS- is the application of a broad spectrum of sciences used to answer questions of interest to a legal system in relation to a crime or a civil action. Many Legal Nurses have expanded their practice by adding forensic training to their repertoire. Forensic science is used to investigate criminal cases involving a victim, such as assault , robbery, kidnapping, rape, murder and civil cases such as forgeries, fraud, or negligence. Due to advancement in technology in the past decade, many cold cases have been brought back to life.

For instance, in 2001, the combination of two different types of DNA tests, the short tandem repeats test (STR) with polymerase chain reaction (PCR), allowed investigators to re-exam evidence which enabled them to amplify and compare samples. These tests proved indispensable, allowing scientists to sequence and copy very short fragments of DNA taken from crimes scenes. Together, these tests closed a 20-year-old cold case, The Green River Killer.

Gary Ridgeway, after confronted with the genetic evidence, pleaded guilty to killing 48 women, mostly prostitutes, during the period of 1982-2001. He was sentenced to 48 consecutive life sentences with no chance at parole.

A report posted on creativityinserialkillers.com, by N.A. Anderson, states that, "Ridgeway confessed that he continued his rampage because he felt that he could get away with it for several reasons: The women he victimized were runaways or prostitutes so no one would go looking for them immediately." But luckily for the Forensic Analyst, Ridgeway did not always wear condoms and left semen in four of the many corpses. This oversight by Ridgeway provided DNA to be retested 19 years later, which helped catch and convict the Green River Serial Killer.

Many of the experts that contributed to this case specialized in DNA identification of decomposed or damaged remains, DNA forensics, STR-PCR, etc. For years, local prosecutors send their samples to private labs for testing due to the lack of Experts in this field. Dr. Barry Logan, forensics crime lab director in Washington, has submitted a plan to meet increasing demands for DNA testing. He has asked for 4 million dollars to hire about 40 more scientists and improve equipment and facilities.

According to the U.S. Bureau of Labor Statistics (BLS), job growth for forensic scientists will increase by 20 percent or more between 2008-2018. Most work for the local government, followed by state governments, hospitals, investigation and security services, and labs. LEGAL NURSE NEWS: THE MEDICARE STRIKE FORCE'S ATTACK

The Medicare Strike Force was established in 2007 as part of the Health Care Fraud Prevention & Enforcement Action Team (HEAT). This multi-agency team of federal, state, and local investigators was developed to shut down large-scale Medicare schemes operating throughout the country and safeguard taxpayer dollars. Their aggressive fight against health care fraud is operating in 9 districts throughout the U.S. They announced last month their expansion to two additional cities. Advanced Legal Nurse Consultants and Certified Legal Nurse Investigators are trained to spot Medicare fraud. More than 1,000 individuals have been charged with falsely billing the Medicare program for more than $2.3 billion. These individuals include doctors, nurses, health care company owners and executives, who are accused of various healthcare fraud-related crimes. Some of the crimes included conspiracy to defraud the Medicare program, violations of anti-kickback statutes, criminal false claims, money laundering and aggravated identity theft.

In March 2011, a Las Vegas woman pled guilty to falsely representing and owning a fraudulent medical supply company that billed Medicare for more than 3.5 million. Medicare reimbursed her company with approximately $1.7 million. Jummal Joy Ibrahim admitted between January 2006 and September 2009 she allowed her brother to use her identity to start Contempo Medical Supplies. Ibrahim claimed she did not know anything about the business and never intended to have any role in the operations or share its profits, according to the documents.

In Houston a few days earlier, Sunny Robinson was convicted of 19 counts of healthcare fraud and anti-kickback violations for the fraudulent claims to Medicare and Medicaid. His profit on these claims accumulated to the amount of $4.3 million.

These are just a few examples of the indictments going on involving the Medicare Strike Force. Due to the courageous whistleblowers coming forward on these cases, more of these cases are being reported. As a whistleblower, you may be entitled to a whistleblower reward of 15-25% due the provisions in the False Claims Act. Legal Nurse Consulting: Florida Woman Awarded 500K for Alleged Injury in Gym Accident

On January 26, 2011, plaintiff Dawn Beauchamp, 42, was awarded $503,398.84 after her lawsuit against Central Florida Fitness Inc. She was injured while sitting on an adjustable bench seat, when the seat collapsed. The accident resulted in a herniated disc which resulted in two surgeries, a discectomy on February, 2008 and a lumbar fusion on Sept 30, 2009. As a Legal Nurse, you may see many similar cases in your practice.

The lawsuit against Central Florida Fitness Inc., which was doing business as Gold's Gym, claimed that the defendant failed to properly repair and maintain the seat, creating a dangerous situation. The defendant claimed it was Beachamps' error and the gym was not at fault. They also argued her injuries were pre-existent to the accident.

Beachamp sued Central Florida Fitness Inc for the following:
Past Medical Cost- $280,962 Personal Injury
Future Medical Cost- $158,236 Personal Injury
Past Pain and Suffering- $130,000 Personal Injury
Future Pain and Suffering- $320,000 Personal Injury

The jury determined the total damages to be $889,198. Beachamp's husband also presented a derivative claim for loss of consortium, but was declined. In the end the jury found Beachamp to be 30% liable. After the comparative liability offset, she was awarded $503,398.84.

According to a blog by David Fuch, from southfloridapersonalinjurylawyers.com, he states, "The defense counsel moved for a new trial, which will be heard on Feb.2, 2011. According to the defense counsel, the motion is based on the courts improper allowance of plaintiff's counsel's disparaging remarks during closing arguments, plaintiff's expert's new opinions at trial, plaintiff's biomechanical expert's opinion regarding the cause of injury and plaintiff's counsel's introduction of evidence regarding subsequent remedial measures. It is also based on the court's instruction to the jury, over objection, allowing the jury to infer negligence because the defendant did not maintain possession of the maintenance log and the weight bench involved. If the motion is denied, defense counsel will appeal."

Is this a fair verdict? Beachamp's past medical bills will be covered, but what about the future medical costs and loss of wages she will endure? The injury she encountered has a 3-11% risk of re-operations over the next five years resulting in additional medical costs.

The Control and Responsibilities of a Legal Nurse Investigator

Legal Nurse Investigators all over the world have moved into positions in order to conduct unbiased and fact-finding investigations occurring on or about Hospital and Health Care Properties. The Special Investigations Unit (SIU), at most major Hospitals, provide services to victims of domestic or workplace violence which may include: court escorts for restraining orders and other appearances, work and home security surveys, threat assessments, and personal safety planning.

The growing need for facilities to keep a Nurse Investigator/Claims Analyst on staff is on the rise, especially in nursing homes. Some feel the nursing home inspection process is full of corruption. There are constant violations against nursing homes regarding abuse and negligence. For example, according to a June 3, 2009 story in West Palm Beach, FL, a resident was treated for a broken leg with a cast. The wound should have been treated every three days according to the state inspection report. However, the Nurse Investigator discovered the nursing home addressed the wound only once a week after documentations had been evaluated. The nursing home was fined $16,000 by state regulators for the negligence of the resident, who was found lying prone on the floor, injured, with maggots crawling out of the cast. As you can see, these positions are crucial in order to investigate facilities tampering with medical records, fraud, malpractice, and negligence.

Patty Klein, We Will Never Forget You

Oftentimes, good news comes packaged with bad news. Unfortunately, this again is the case with Ryan and Veronica's wedding. The morning after their wedding, Veronica was awoken by a phone call bearing bad news. Patty Klein passed away in a car accident on December 30th at 9am. Patty was a close friend to many at RN MARKET, an expert in some of Veronica's cases, one of Veronica's wine girls in her wine blogs and one of RN MARKET's best legal nurse consulting clients. Many of you have met her at various RN MARKET events. Most recently, she attended the Indulge conference in Tampa.

Patty was driving on an interstate off-ramp when her vehicle veered onto the grass. She overcompensated causing the vehicle to spin and overturn. While the vehicle was flipping, it hit an oak tree. She died instantaneously. Patty was 39-years-old.

How Legal Nurses Exhibit at Attorney Conferences

Below are some key things for Legal Nurses to remember when exhibiting at any conference.

1.It is ideal to have a large professional display banner with your company name and logo on top or in front of your table that is easily recognizable to the room.

2.A PowerPoint presentation set-up at your table is a very modern and professional way to show your product or services to a busy room.

3.Ask where your table will be in the room so you can request a better spot if possible and how many people are expected to be exhibiting and attending.

4.Ask what exactly is provided at the conference to know what you will have to bring with you (tablecloth, extension cords, chair, etc...).

5.If possible purchase promotional items to advertise your business. Pens, small water bottles, nail files, highlighters, pocket calendars, reusable shopping bags, are all reusable items that will have your client looking at your items more than once after they leave the conference.

6.Have a drawing for a Visa gift card, gift card to a nationwide chain restaurant, or any other item of your choice. This will bring people to your table. Have them fill out an entry form or drop in a business card for the prize. Once they enter, you will then have all of their contact info to use for future mailings, or email advertisements.

7.If the drawing is not something you are interested in doing then have a fun game such as golf or trivia to allow the people to win a prize. This is always a good way to get a crowd involved.

8.Brochures and Marketing materials are a must. You need to look professional and organized to attract people to your table and your services. A custom-made logo and marketing materials will make it clear to your client as to what you can do for them and why they need you for their cases. Have something ready that they can take with them other than just your business card.

9.Any type of candy, chocolate or bottled water will attract people to your table. There may be an additional cost, but one thirsty person may end up giving you your next big case!

10.Do not sit down behind your table. Make sure you are standing and ready to greet any potential client that has shown interest in your table.

11.Arrive early to set up your table. You don't want to start off giving a bad impression by scrambling to get ready.

12.If you are having employees help at your booth, request that they are dressed professionally or in some uniform way so they are easily recognizable as part of your team. Make sure they can easily answer any questions and provide help to anyone that needs it.

13.Have fun! Exhibiting is a wonderful way to network with your future clients and others in your field. It can provide you with a personal touch that can really get your foot in the door for your next cases. Exhibiting can become expensive. U.S. Attorney's Office Seeks Triple Damages, Restitution, and Other Penalties from Johnson and Johnson

BOSTON- The U.S. Attorney's office filed a complaint in January 2010 against Johnson & Johnson for violating the anti-kickback statute and False Claims Act. Allegedly, J & J paid kickbacks for five years to Omnicore Inc, a long term care pharmacy, to increase the number of elderly patients taking the antipsychotic Risperdal and several other medications.

Omnicare, due to its contract with J & J, sent faxes to thousands of doctors asking them to switch their dementia patients to Risperdal. Between the years of 1999 though 2004, Johnson & Johnson's annual sales jumped from $100 million dollars to more than $280 million. The pharmacy's annual purchase of Risperdal rose to more than $100 million, according to the complaint filed.

Risperdal is approved by the Food and Drug Administration to treat schizophrenia and bipolar disorder, it is not specifically approved to treat behavioral problems in elderly people with dementia. In fact, in 2005 the FDA required that Risperdal carry the black box warning label. It warns that elderly people treated with this drug had an increased risk of death compared to those taking placebo.

Regulations, enforced by the government, are in place to protect residents in nursing homes from medication mismanagement. However, the outside consulting pharmacists in charge of reviewing the patient's medication once a month may be involved. They have the authority to recommend that a physician remove, change or add medications to the patient's drug regimen. The government complaints that the very people entrusted with safeguarding the integrity of nursing home drug prescriptions are the ones guilty of corporate gain.

Day after day, pharmaceutical companies betray proper business ethics for financial gain. Therefore, more Certified Product Safety Specialists and Legal Nurse Investigators are needed to help the victims on these cases.

Certified Product Safety Specialists (CPSS) are responsible for minimizing the risks in the product safety industry by identifying, screening, reviewing and reducing potential problems. The Lawsuits and Litigations Involved with Chinese Drywall

Since July 30, 2009, companies have been facing lawsuits for distributing Toxic Chinese Drywall. These companies include Chinese based manufacturers, as well as importers, developers and builders, contractors, suppliers and others. There have been hundreds of cases reported involving property damage and health problems.

As a Product Safety Specialist, it is important to be aware of the side effects and problems provoked by this product, especially when dealing with related cases in Florida, Louisiana, Alabama, Georgia and Virginia since these states have been impacted at the highest rate. Reports show that the Chinese drywall leaks corrosive chemicals that turn copper tubing black, causes the failure of air conditioning coils exposed to the drywall, causes corrotin on mirrors and fixtures, smells of sulfur, and causes respiratory problems, premature aging, nose bleeds, and headaches from airborne compounds.

Florida Inspectors argue that homes built between 2000-2007 should be tested for the contaminated drywall before they are sold. Inspection firms will test the indoor air quality to prevent the purchase of a contaminated home. A recent report shows that complaints about this product are on the rise in Arizona and California.

An example of how the drywall was produced and how it might have become toxic was reported on lawyersandsettlements.com, the gypsum materials used was filtering media in smoke stacks of coal-fired power plants to reduce air pollution. This combination will create gas releasing sulfuric acid.

According to Sean Wajert on August 25, 2010, The Georgia Superior Court has preliminarily approved a $6.5 million settlement between the Lowe's home improvement stores and a nationwide proposed class of drywall purchasers. Wajert states in April of 2009, Rep. Robert Wexler, D-Fla., introduced a bill to temporarily ban drywall with high levels of organic compounds. The bill H.R. 1977 would also commission a study on imported Chinese drywall. Sens. Bill Nelson, D-Fla., and Mary Landrieu, D-La., introduced the Senate version of the legislation, the Drywall Safety Act of 2009, recently in the U.S. Senate. The House bill would require the U.S. Consumer Product Safety Commission to create a standard to regulate the composition of drywall.

Although the temporary ban will protect some future consumers, the damage has already been done. There are thousands of pending cases and more that will come to the surface. Have you picked up the classifieds lately and looked in the employment section? Of course you haven't, you are trying to start your own business. Well, pick it up!
